Property DivisionProperty
A divorce necessarily entails the division of property. In Texas, there are two types of property at play in a divorce: separate property and community property.
Generally, separate property is the property you owned before you were married. Such property should remain yours after the divorce. Community property, on the other hand, is all the property acquired during the marriage. Regardless of whose name is on the deed, account, or title, or who earned the money, if the property is characterized as community property, it is deemed to be owned 100% by each spouse. The Court's job is to somehow divide this property in a "just and right" manner. This is far more complex than just splitting everything 50/50. There are many factors that can permit a Court to award one spouse far more -- or far less -- than the other. This is where an experienced attorney is necessary. Mr. Rea II has a background not only in family law but also complex commercial litigation. This experience provides a distinct advantage to Mr. Rea's clients; many of whom own property in several states, possess complex retirement accounts, and own closely-held business interests. Under many circumstances, either you or your spouse will be eligible to seek spousal maintenance. This Texas-style alimony requires one spouse to pay the other on a monthly basis for a set period of time. Mr. Rea had had great success in obtaining such maintenance for his clients that needed it. Likewise, he has had great success in preventing his clients from paying it.

Child CustodyCustody
If you have children of the marriage, the Court will enter orders setting forth your rights in regard to the children. In Texas, 'custody' entails several things.
First, the Court will determine the type of Conservator you will be. Depending on the type of Conservator, you may have the exclusive right to make certain decisions regarding the children. Or, you might have shared responsibility for these decisions with your ex-spouse. Second, the Court will determine a possession and access schedule. There is a 'default' possession schedule outlined in the Texas Family Code, referred to as the "Standard Possession Order." With this schedule, one parent has the children on the first, third, and fifth weekends of each month, major holidays are alternated, and the summer is divided into two fairly equal chunks of time. Mr. Rea understands that this cookie-cutter schedule is not appropriate in all situations. If you want an attorney to fight for a schedule that reflects the needs of your children, call us and make an appointment. Third, it is worth mentioning the various provisions that parents usually don't think about. How should the possession schedule change if your ex-spouse remarries? What school should the child attend? What happens if one parent needs to move? What will happen if someone is deployed? These issues are the things that a good attorney will counsel you about. We strive to resolve as many issues as possible in the Decree and anticipate future circumstances. Child Supportchild support
If you have children with your spouse, one or the other of you will be paying child support. Child Support in Texas is, for the most part, set by statute. That is, there are certain guidelines that dictate the percentage of one's after-tax income that must be paid. However, if you or your spouse has a high-income or income that is difficult to ascertain, there is a great deal of discretion granted to the Court in setting support. It is vital to have an attorney who will fight for every last penny to which your children are entitled. And, likewise, if you are the potential obligor, it is vital to have an attorney who can minimize the amount you have to pay.
